Write an electronic appeal to the affiliated republican unitary enterprise "Gosstroyexpertiza for Mogilev region "

In connection with incoming electronic appeals on various issues of architectural and construction activities, the state enterprise Glavgosstroikspertiza informs that the competence of the enterprise is only to conduct state expertise of town planning and design documentation in construction in accordance with the procedure established by the Council of Ministers of the Republic of Belarus on October 8, 2008. No. 1476, as well as explanations relating to the conduct of state expertise of the town planning and project documents in construction.

The issuance of recommendations for the design of construction sites, advice on the design decisions taken, except for cases of expert support for project documentation carried out on a contractual basis, clarification of the application and content of the requirements of technical regulatory legal acts is not within the competence of the state examination bodies.

In accordance with Article 16 of the Law of the Republic of Belarus of July 5, 2004 No. 300-Z On Architecture, Town Planning and Construction Activities in the Republic of Belarus, the Ministry of Architecture and Construction of the Republic of Belarus is a specially authorized state body in the field of architectural, town-planning and construction activities. The powers of the Ministry of Architecture include, among other things, the organization of scientific, methodological and information-analytical support for architectural, town-planning and construction activities, methodological guidance of structural divisions of local executive and administrative bodies exercising state authority in the field of architectural, town-planning and construction activities, development and adoption of NAP in the field of architectural, town-planning and construction activities, including le development and adoption of technical regulations in the field of technical regulation and standardization in accordance with the law on technical regulation and standardization.

It should also be noted that in accordance with the Law of the Republic of Belarus of January 5, 2004 No. 262-З "On Technical Regulation and Standardization," official interpretations on the application and content of the requirements of the TNPA are given in accordance with the established procedure by the body that approved these TNPA.

We draw attention to the fact that on the basis of Article 25 of the Law of the Republic of Belarus of July 18, 2011 No. 300-3 "On Appeals of Citizens and Legal Entities", electronic appeals must comply with the requirements specified in clauses 12-3 of Article 12:

  1. The appeals are presented in Belarusian or Russian;
  2. Citizens' appeals must contain:
    • name and (or) address of the organization or position of the person to whom the appeal is sent;
    • surname, first name, patronymic (if any) or the initials of the citizen, the address of his place of residence (place of stay);
    • statement of the essence of the treatment;
    • e-mail address of the applicant.
  3. Appeals of legal entities must contain:
    • name and (or) address of the organization or position of the person to whom the appeal is sent;
    • full name of the legal entity and its location;
    • statement of the essence of the treatment;
    • surname, first name, patronymic (if any) of the head or a person authorized to sign applications in accordance with the established procedure;
    • e-mail address of the applicant.

Electronic appeals can be left without consideration on the merits in cases if they:

  • not in Belarusian or Russian;
  • do not contain a surname, own name, patronymic, address of the place of residence (place of stay) of the citizen;
  • do not contain the full name of the legal entity and the address of its location, surname, own name, patronymic of the head or a person authorized in accordance with the established procedure to sign appeals (for legal entities);
  • contain a text that can not be read;
  • contain obscene or offensive words or expressions;
  • are subject to review in accordance with the legislation on constitutional legal proceedings, civil, civil procedural, economic procedural, criminal procedural legislation, legislation determining the procedure for the administrative process, legislation on administrative procedures or in accordance with legislative acts established a different procedure for filing and reviewing such appeals;
  • contain questions that do not fall within the competence of the bodies of state expertise;
  • the period for filing a complaint is missed without good reason;
  • a repeated appeal has been filed if it has already been examined on the merits and does not contain new circumstances relevant to the consideration of the appeal on the merits;
  • with the applicant, correspondence on the issues stated in the appeal was terminated.

The response to the appeal or decision to leave the appeal without consideration on the merits may be appealed to a higher organization - the State Committee for Standardization of the Republic of Belarus, Starovilensky Trakt, 93, Minsk, 220053, http://www.gosstandart.gov.by.

On the official website of the state enterprise "Glavgosstroyekspertiza" (http://www.glavexpertiza.by), the answers to the most frequently raised questions in electronic appeals can be posted in the global computer network without sending responses (notifications) to the applicants.
